Lindsay Lohan to Spend 90 Days behind Bars for Probation Violation

Lindsay Lohan has been sentenced to 90 days of jail time and 90 days in inpatient drug and alcohol rehabilitation for violating the terms of her probation on a 2007 DUI and reckless driving conviction.

Lohan’s 2 years of probation was set to expire in 2009, but she was found in violation of the terms of her probation agreement, causing the case judge to add an additional year of probation to her sentence. The owner of the Right On Alcohol Education Program where Lohan has been (sometimes) attending her mandatory classes said at that time that the actress was not in compliance with the terms of her probation and that her excuses had been “endless and disrespectful”.

After skipping a court meeting in May, Judge Marsha Revel ordered the actress to wear an alcohol monitoring bracelet and this device did report the use of alcohol on June 7th. The judge however disregarded this reading as a potential false positive after prosecutors failed to present a witness who could confirm that Lohan was in fact consuming alcohol that night. Had the judge accepted the reading, Lohan could have faced as much as 6 months of jail time for the violation.

Nevertheless, because Lohan had missed 7 of her mandatory Alcoholics Anonymous classes over a 27 week period, the judge found her guilty of probation violation.

Speaking before sentencing, Lohan asked for leniency, crying as she spoke directly to the judge, saying, "As far as I knew, I was being in compliant with my Right On program. When I would ask to leave town, they would give me permission to leave town. I did do everything I was told to do…I'm not taking this as a joke. It's my life, it's my career. It's just been such a long haul and I don't want you to think that I don't respect you and your terms."

In sentencing Lohan to 90 days of jail and 90 days of inpatient treatment, Judge Revel rejected any claims of misunderstanding, saying that the terms of the probation had been made very clear, and added, "Nowhere did I say substantial compliance would be good enough."

Lohan broke into tears upon hearing her sentence.

Lohan will serve her jail time, beginning on July 20th at Century Regional Detention Facility in Lynwood, Calif.
